Terms of Service for CounselAI

Welcome to CounselAI! These Terms of Service ("Terms") govern your use of the CounselAI mobile application (the "App") and any related services provided by Syed Aabis Akhtar ("I", "me", or "my"). By creating an account or using the App, you agree to be bound by these Terms.

1. Description of Service

CounselAI is a mobile application designed to assist students with the college application process. The App provides the following key features:

  • AI-Powered Essay Feedback: Users can submit their college essays and receive AI-generated feedback on various aspects of their writing, including an AI originality check.
  • Supplemental Essay Idea Generation: The App helps users brainstorm ideas for supplemental essays based on their profile information and the selected college.
  • Activity Logging: Users can track their extracurricular activities.
  • College List Management: Users can create and manage a list of colleges they are interested in.

2. Eligibility and User Accounts

To use CounselAI, you must be at least 13 years old. By creating an account, you represent and warrant that you meet this age requirement.

You are responsible for maintaining the confidentiality of your account information, which is managed through Google Sign-In or Sign in with Apple. You are also responsible for all activities that occur under your account. You agree to provide accurate, current, and complete information during the onboarding process and to update such information to keep it accurate. This information may include your name, email, high school, intended major, student type (domestic/international), and SAT scores.

3. Subscriptions and Payments

CounselAI offers a free plan and paid subscriptions ("Monthly Pro" and "Lifetime Pro").

a. Free Plan:

The free plan may include a limited number of free uses for certain features, such as one free analysis for the Essay Feedback, Activity List, and Supplemental Essay features. I reserve the right to change the terms of the free plan at any time.

b. Paid Subscriptions:

  • Monthly Pro: This is a recurring subscription billed on a monthly basis.
  • Lifetime Pro: This is a one-time purchase that grants you access to all pro features for the lifetime of the App.

All payments are processed through Apple's in-app purchase system. You agree to abide by Apple's terms and conditions for in-app purchases.

c. Subscription Renewals and Cancellations:

Monthly subscriptions will automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel your subscriptions through your Apple account settings.

d. Refunds:

All purchases are final and non-refundable, except as required by law or as permitted by Apple's policies.

e. Restoring Purchases:

If you reinstall the App or get a new device, you can restore your previous purchases using the "Restore Purchases" feature in the App's profile section.

4. User-Generated Content

You retain ownership of any content you submit to the App, including your essays, personal statements, and activity descriptions ("User Content").

By submitting User Content, you grant me a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and process your User Content solely for the purpose of providing the App's services to you. For example, your essays are sent to a secure backend and processed by an AI model (OpenAI) to generate feedback. As stated in our Privacy Policy, your data is not used to train OpenAI's models.

You are solely responsible for your User Content and the consequences of submitting it. You represent and warrant that you have all necessary rights to submit the User Content and that your User Content does not infringe upon the rights of any third party.

5. Prohibited Conduct

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Submit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Attempt to reverse engineer, decompile, or otherwise discover the source code of the App.
  • Use any automated system to access the App or scrape data.
  • Interfere with or disrupt the integrity or performance of the App or its servers.

6. Third-Party Services

The App integrates with third-party services to provide its functionality. These services include:

  • Firebase (Google): For authentication and backend data storage.
  • RevenueCat: For managing in-app subscriptions.
  • OpenAI: For providing AI-powered features.

Your use of these third-party services is subject to their respective terms and privacy policies. I am not responsible for the practices of these third-party services.

7. Intellectual Property

All rights, title, and interest in and to the App and its content (excluding User Content), including all associated intellectual property rights, are and will remain my exclusive property. The CounselAI name, logo, and the overall look and feel of the App are my trademarks and may not be used without my prior written permission.

8. Disclaimers and Limitation of Liability

The App is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. While I strive to provide a high-quality service, I do not warrant that the App will be uninterrupted, error-free, or completely secure.

The feedback and suggestions provided by the App's AI features are for informational purposes only and should not be considered as definitive advice for your college applications. You are ultimately responsible for your own application materials.

To the fullest extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the App.

9. Termination

I may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

You can terminate your account at any time by using the "Delete Account" feature in the App's profile section, which will guide you through the process of sending an account deletion request via email.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the jurisdiction in which I am based, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App will be resolved in the courts of that jurisdiction.

11. Changes to These Terms

I reserve the right to modify these Terms at any time. If I make material changes, I will provide you with notice, such as through an in-app notification. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
